Terms of Service
Please read these Terms of Service (“Terms”) carefully before using ShotCoach at shotcoach.eu (the “Service”) operated by Thalerys Systems (“we”, “our”, or “us”).
By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or at least 13 years old if you are a resident of the United States) to use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you confirm that you have your parent's or legal guardian's permission.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@shotcoach.eu if you suspect unauthorised access.
You may not create an account on behalf of another person without their express permission, or use a false identity to create an account.
3. Subscriptions and Billing
3.1 Free tier
The Free plan is available at no cost and includes a limited number of training sessions per month and 30 days of history. We may change the limits of the Free plan with 30 days' notice.
3.2 Paid subscriptions
Paid plans are billed in advance on a recurring basis (monthly or annually, as selected). Prices are displayed in USD and exclusive of applicable taxes. All payments are processed by Stripe. By subscribing, you authorise us (via Stripe) to charge your payment method on each renewal date.
3.3 Cancellation and refunds
You may cancel your subscription at any time from your account's billing page. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not provide pro-rata refunds for unused portions of a billing period, except where required by applicable law.
If you are an EU or UK consumer you have a statutory right to withdraw from a contract within 14 days of purchase (“cooling-off period”), provided that you have not yet started using the paid features of the Service. To exercise this right, contact us at support@shotcoach.eu within 14 days of your purchase.
3.4 Price changes
We may change subscription prices with at least 30 days' notice. If you do not cancel before the new price takes effect, you will be charged at the new rate.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload content that is illegal, defamatory, abusive, obscene, or that infringes any third-party rights.
- Attempt to gain unauthorised access to any part of the Service or its underlying systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
- Scrape or systematically download content from the Service without our prior written consent.
- Resell or sub-license access to the Service unless expressly permitted in writing.
5. Your Content
You retain all intellectual property rights in the training data, target images, and other content you upload to the Service (“Your Content”). By uploading Your Content you grant us a limited, worldwide, royalty-free licence to store, process, and display it solely as necessary to provide the Service to you.
You are responsible for ensuring you have the right to upload Your Content and that it does not violate any third-party rights.
We may use aggregated, anonymised, and de-identified data derived from Your Content to improve the Service (for example, to improve AI shot-detection accuracy). We will never disclose Your Content in a form that identifies you without your consent.
6. Our Intellectual Property
The Service, including its software, design, trademarks, and all content created by us, is owned by Thalerys Systems and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trade names, trademarks, logos, or domain names.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Shot-detection results produced by AI are estimates and may contain errors; they are not a substitute for your own judgment.
Nothing in these Terms excludes or limits any statutory rights you may have as a consumer under applicable law that cannot be waived by contract.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THALERYS SYSTEMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD 100.
WHERE APPLICABLE LAW (INCLUDING EU CONSUMER LAW) DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY DESCRIBED ABOVE, THOSE EXCLUSIONS AND LIMITATIONS SHALL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to indemnify and hold harmless Thalerys Systems, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Termination
We may suspend or terminate your access to the Service immediately, with or without notice, if you materially breach these Terms or if we are required to do so by law. You may terminate your account at any time from the account settings page.
On termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 6, 7, 8, 9, and 11) shall survive.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict-of-law principles. If you are a consumer resident in the EU or UK, you also benefit from any mandatory consumer-protection provisions of the law of your country of residence.
We encourage you to contact us first at support@shotcoach.eu to resolve any dispute informally. If we cannot reach a resolution, disputes will be submitted to the courts of Norway, unless mandatory consumer-protection law in your country requires otherwise.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or by a notice within the app at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
